Gear down would invalidate a lot of numbers in the manual.
I suppose it would be too complicated to write a one-size-fits-all exception like "May be inoperative provided flight is not conducted in icing conditions and flight planning must consider increased fuel burn, decreased range, decreased OEI climb gradient", etc. because a pilot wouldn't be able to know exactly to what extent having the gear down changes those numbers. So the FSDO probably wants to see everything on a case-by-case basis.
Would be interesting to see Mike T's ferry permit and what the limitations were.

Need to be on a ferry permit if you are going to have the gear down.
