From I've been told on my many conversations with CubCrafters (and factory visit in September). the 80HP restriction is really meant to keep the airplane under the 'regulatory' speed limit of 100kt for LSA.

The GrossWeight conundrum is further evidenced in the Experimental Kit version, where you're required to 'elect' LSA or E-LSA certification which could affect your ability to continue to fly the thing after stopping renewing your medical, for example. or loaning the aircraft to a SportPilot only rated person. It's the SAME airplane!

The LSA speed limit is 120 knots. You'd need a lot more horses to get a cub going that fast.

Marcus: The speed limit is closer to 120kts. So that really isn't an issue. The issue is that there is some sort of a formula for either gross weight or empty weight which includes maximum continuous power...and less is better. Hence the 80 hp continuous placard.

As far as the home built, it can either be E-LSA or Experimental. It can't be LSA. E-LSA operates under the same rules as LSA but the empty weight can be higher...and there are less limits on after dark flight.

Experimental is just like an RV-8 or whatever.
