About 10:00 into the video he talks about some air pressure buildup in the nose area, as he pitches to a higher angle of attack[i] at rotation, that affects his static system and makes the altimeter read a bit low and the airspeed also a bit low.
Looks like I called that wrong in my commentary about his pitot-static system earlier today; I thought it was air moving around as a result of him [i]throttling back (and it affecting the static system). I don't mind being wrong (not the first nor the last time) and I'm glad he's narrowed down his troubleshooting on that particular system.

I’m not clear on the rules. Is it legal for him to fly it?
I know it’s not smart, but what is the process of getting an E-AB aircraft approved for a test flight and what are the required qualifications of a test pilot?
So far as I’m aware there is not FAA approved test pilot rating and all he’d need is appropriate ratings for category and class to be legal to fly the plane.

The DAR signed off the airplane long ago. Those pesky test pilots keep adding things to his laundry list.
